Intestacy. That means you don’t have a will. And when you don’t have a will there are certain problems that can arise. For example, if you die without a will and you have children, believe it or not your spouse does not inherit everything that you own. In fact there is a percentage that goes automatically to your children and a percentage that goes to the spouse. This presents all kinds of problems when you have minor children. For that reason, and if for no other reason, that’s a great reason you should come in and do a will. But intestacy is the way in which the state determines how your property is going to be distributed to your heirs. You may not like it but the state makes the decision.
